"Hidden Gun!"

OAKLAND, Calif. (WCJB) -- The family of a man shot and killed by Oakland police claim he never pointed a gun at an officer, but authorities say witnesses have a different story. Alan Dwayne Blueford was killed early Sunday morning after being chased by police.


According to police, two officers thought one of the men had a gun, so they decided to stop them and that's when all three took off running. One officer chased Blueford for about two blocks. The officer fired at Blueford four times, according to the coroner's report. Blueford was hit in the front of his body with three rounds. Investigators believe a fourth round hit the officer in his own foot.

The Oakland Police Department and the Alameda County District Attorney's Office are investigating the fatal shooting.

Back Shot!

Oakland, CA -- Tony Jones, the cousin of Oscar Grant, is recuperating from a police-inflicted bullet wound in the same hospital where his cousin died after being shot by an officer three years ago. Grant, 22, was shot on New Year's Day 2009 by a Bay Area Rapid Transit officer on a platform in Oakland after he was one of several people restrained by officers responding to reports of a fight. Grant, who was unarmed, died from his wounds. Officer Johannes Mehserle was convicted of involuntary manslaughter and served half of a two-year sentence. The Mehserle verdict sparked riots in Oakland, where many wanted the officer found guilty of second-degree murder. Mehserle testified during his trial he had meant to use his stun gun to restrain Grant.

Oakland Police have said very little about the Sunday night incident in which Jones, 24, was shot in the lower back while running from officers after his vehicle had been pulled over for being associated with a robbery.

"The officer ran after the passenger, and discovered the passenger was in possession of a firearm. The officer discharged his firearm, which struck the passenger," police said in a statement, adding that a firearm had been recovered from the scene. Jones' lawyer said his client did not have a firearm and called the officers "negligent," accusing them of using "unreasonable force." "[Jones] is 24 years old. He' a young guy and he started to run," his attorney said. "He knew his cousin had gotten shot by the police before. He had grown up in an environment where he was afraid of police officers." The attorney, along with Jones' mother, Bertrina Works-Grant, were denied access to Jones' hospital room for several hours by the Oakland Police Department, McCoy said, even though Jones was not under arrest and charges hadn't been filed. "The police stopped me at the door and, meanwhile, he's in there loudly requesting to see his attorney," the lawyer said. After speaking with a supervisor,the attorney and Works-Grant were able to see Jones. "I talked to my son,'" Works-Grant told media sources. "My son said 'Momma, the officers [are] lying. They watched me get out of the car. They watched me walk. They started speeding up and I took off running across the street. And when I took off running ... I heard the gun go pow pow pow." The Oakland Police Department did not return a message from news reporters. The attorney said he planned to seek unspecified damages on behalf of his client. "There's a long way to go," he said. "There's a lot of young African-American men that are being stopped and shot by the police without them going through the protocol."

Another O.P.D. Homicide!

November 8, 2010 OAKLAND, CA -- A 37-year-old Oakland man was killed in an officer-involved shooting Monday night, police said. Police responded to a domestic dispute between a man and a woman in the 5800 block of Bancroft Avenue at 9:40 p.m., police spokesman Officer Jeff Thomason said. When officers arrived, the man ran toward Trask Street. More officers arrived and found the man in the 5800 block of Trask Street. The officers fired several rounds from their service pistols. The man was hit and pronounced dead at the scene.
No officers were injured in the incident. The officers' names are not being released at this time. They have been put on administrative leave, which is routine in officer-involved shootings. The shooting is being investigated by the homicide and internal affairs sections and the District Attorney's Office, and police have not said what prompted the shooting. "THESE ARE HARD times for the city of Oakland. To get out of a deep financial hole, the City Council set to cut libraries and museums, eliminate civilian police department employees, slash public works and make other cuts in services that our residents need. In the middle of this financial crisis, a Pleasant Hill law firm has decided to hit Oakland taxpayers with a lawsuit that amounts to little more than a shakedown. The class action lawsuit, instigated by Mike Rains, an attorney best known for representing Barry Bonds [and the Oakland Riders (Corrupt Oakland Police Officers who planted evidence on Oakland Citizens)], would force Oakland to pay millions of extra dollars in overtime to cops — but not for patrolling the city's streets or investigating crimes." Incredibly, three of the lead plaintiffs [Police Officers] were fired for cause: • One for threatening an elderly couple with his service handgun; • one for watching pornography while on duty; and • one for providing police investigation information to the criminals under investigation. Yet plaintiffs' attorneys want Oakland residents to pay these three former officers for the time they spent putting on and taking off their uniforms. • One plaintiff in the lawsuit, a sergeant making $115,000 [per year with a high school diploma], is demanding overtime for the few minutes of reading e-mail and making phone calls he does before his shift. At the same time, he admits making personal phone calls and reading personal e-mail on the city's dime. • This same sergeant drives an unmarked police vehicle to and from his home in Concord — the city pays for gas and repairs. Once a week, however, he spends about 11 minutes dropping off paperwork on his way home. He is in court demanding overtime for those 11 minutes. • One veteran testified that it takes him 30 minutes to put on his uniform — including 10 minutes to pin on his medals. One lieutenant wants overtime for the few seconds he spends shaking his pepper spray before each shift. "[T]he relationship between Longmire and the Bey family seemed to trouble another homicide detective. Homicide Sgt. Lou Cruz, assigned to write one of the search warrants for the Aug. 3, 2007 raid on the bakery, did the work at home to keep Longmire ignorant, said two officers familiar with Cruz's actions. "Cruz was worried about Longmire," one of them said. Cruz did not return a call requesting an interview." Related Acts of Oakland Police Corruption • (October 2008) At least 12 Oakland Police officers have been pulled from street duty while investigators examine their warrant applications in drug cases. The officers in question are accused of making "misstatements" in those applications, claiming substances purchased in undercover buys from suspects were actual narcotics, when in fact that had not been confirmed by the police crime lab when the warrants were issued. OAKLAND, Calif. -- In the wake a growing Oakland police scandal, Alameda County District Attorney Tom Orloff announced Tuesday that his office was forced to dismiss charges in a case involving evidence that was illegally seized by Oakland police officers based on a faulty search warrant. “There is no good faith here, these are willful,” said assistant public defender Ray Keller. “The thing that is really disturbing is that it is a reckless disregard for the truth; they are lying to judges.” • (September 2008) The city was hit with fresh allegations this week that a former Oakland police officer [Richard Valerga] pulled a woman over for no reason and touched her inappropriately. A civil rights lawsuit filed Monday alleges that Richard Valerga stopped a woman in March 2005, ordered her to sit in his patrol car and held her hand and touched her leg and thighs before letting her go. It was the latest complaint in a case that has already cost the city $2 million. The [Oakland] City Council agreed in July [2008] to pay $2 million to settle a complaint brought by 16 women who said Valerga groped or sexually harassed them before he left the police department in 2005. • (December 2007) Thirty (30) [African-American] men have filed a $10 million federal civil rights lawsuit against the city of Oakland in the latest complaint to accuse police officers of conducting invasive and illegal strip searches of them in public. Police officers pulled down the men's pants and exposed their genitalia or buttocks on the street during incidents from 2003 to 2007, the plaintiffs said in the suit filed Wednesday in U.S. District Court in San Francisco. The searches occurred in public throughout the city, including in West and East Oakland and in the city's Temescal neighborhood, according to the suit. • (December 2006) An Oakland police sergeant, Chris Del Rosario, will stand trial in Sonoma County on charges he assaulted his girlfriend and threatened two witnesses with a gun who tried to stop him, officials said. He was previously accused of making homophobic slurs while on duty on two occasions in 2001 and 2002. In the 2001 incident he was suspended without pay and the other complaint was resolved through mediation. In 1995 he was convicted of pointing a pistol at a Livermore man in Pleasanton in November 1994 while off-duty, firing some shots into the air and then leading police on a high speed chase which ended on Interstate 580. Update: Christopher Del Rosario, an Oakland police officer since 1993 and a sergeant since 2003, pleaded guilty to the charge last month as he was about to stand trial for the incident, the Sonoma County District Attorney's office has announced. In exchange for his plea, the district attorney's office dropped two felony counts filed against Del Rosario for brandishing a gun at a person in a vehicle and a misdemeanor charge of domestic violence. Del Rosario initially pleaded not guilty to the crime and was set to go to trial this summer. However, last week he changed his plea to guilty. He could face a maximum of 19 years in jail when he is sentenced Oct. 17. But Deputy District Attorney Christine Cook said a judge has indicated that Del Rosario probably will get one year in county jail and five years probation for the crime. The sergeant recently retired from the Oakland Police Department on a disability. He previously had been on disability leave for a medical problem with his shoulder and other injuries. (Collecting a Disability Pension at Oakland Taxpayer Expense). • (February 2003) In by far the largest legal settlement in Oakland municipal history, plaintiffs who claimed they were victimized by a group of rogue cops known as "the Riders" will share $10.5 million in damages, The Chronicle has learned. The settlement also will bring major changes in how the police department operates and deals with the public, officials will announce today at a City Hall news conference. The payout will go to 119 plaintiffs who filed federal civil rights lawsuits claiming four police officers kidnapped, beat and planted drugs on them during the summer of 2000. The plaintiffs alleged that the Oakland Police Department either encouraged or turned a blind eye to the abuse. Three of the four Oakland (Rider) Police officers involved are pictured from left to right, Matthew Hornung, 31, Jude Siapno, 34, and Clarence "Chuck" Mabanag, 37 (behind Siapano) - Pictures are from 2003. • Note: In 2007 Matt Hornung, then 35, (pictured above to the far left) received $1.5 million dollars from the City of Oakland's "insurance carrier, Kemper Insurance Companies, said Erica Harrold, spokeswoman for Oakland City Attorney John Russo." Hornung said [...] of the settlement, "It's a compromise. There were no winners in this." He said he and his wife, Tai, a San Leandro police officer, "just want to move on and raise our daughters, ages 1 and 3." Hornung's lawsuit claim[ed] Officers Keith Batt and Steve Hewison, who were rookies at the time, and Sgt. Jon Madarang, who worked in internal affairs, lied on the stand in hopes of convicting Hornung and Officers Clarence "Chuck" Mabanag and Jude Siapno. In any event, it is unheard of for a criminal defendant who is acquitted to win money in a lawsuit. The law of the State of California [and the laws of the United States] holds that a witness in any judicial proceeding (court, etc.) is immune from civil suit ... even if the witness testified falsely under oath ("witness-immunity"). "The United States Supreme Court has held that trial witnesses are entitled to absolute immunity from subsequent civil liability for their trial testimony. Briscoe v. LaHue, 460 U.S.325, 103 S.Ct. 1108, 75 L.Ed.2d 96 (1983)." • Corrupt Justice: O.J. Simpson was acquitted of murder and was sued for $33.5 million dollars. A white police officer is acquitted and wins $1.5 million dollars. OPD: A Racist & Homicidal Police ForceOakland Police Officer, Sgt. Pat Gonzales (a Mexican), a 10-year veteran, shot and killed Gary King Jr., 20, about 5 p.m. Thursday, September 20, 2007 near 54th Street and Martin Luther King Jr. Way in North Oakland, California (Third (3) Shooting, all Black men). Gonzales told investigators King started to reach down toward his waistband. Gonzales tried to stop the movement and felt the gun. OPD Officer Pat Gonzales, a department firearms instructor and SWAT team member, was cleared of any wrongdoing in the previous two shootings, police said. In June 2006, Gonzales shot and wounded 17-year-old Amir Rollins, who was armed with a sawed-off rifle on the 1800 block of East 25th Street, police said. In March 2002, Gonzales shot and killed Joshua Russell, 19, of Hayward after he and an accomplice tried to rob a man at gunpoint in the parking lot of a Burger King restaurant at 14th Avenue and East 12th Street. • The First Murder (December 31, 2007): OPD Officer Hector Jimenez (a Mexican) graduated from the Oakland (California) police academy in February 2007. Ten (10) months later, on December 31, 2007, Jimenez pulled over 20-year-old Andrew Moppin. Officers Hector Jimenez and Jessica Borello (a Mexican) shot and killed 20-year-old Andrew Moppin-Buckskin at 47th Avenue and International Boulevard after he ran from his car following a traffic stop, police said. Moppin-Buckskin was not armed, but the officers believed he had been reaching for his waistband, police have said. Less than seven (7) months later, Officer Jimenez would kill again under the "reaching for the waist-band" defense. The Second Murder (July 25, 2008): On July 25, 2008, Officer Jimenez shot and killed Mack "Jody" Woodfox III, age 27. Officer Jimenez said he believed Woodfox, a drunken-driving suspect, had been reaching into his waistband for a gun when he jumped from his car and ran after a chase that ended at East 17th Street and Fruitvale Avenue in the Fruitvale district. Woodfox , who was shot in the back, turned out not to have a gun. Not only was Woodfox found to be unarmed, but a preliminary autopsy revealed that he was shot "numerous times" in his back from approximately 25 feet away. (Second Shooting, both unarmed victims were African-American males.) It's time for the Federal Government to take over the Oakland Police Department.
